Popular Conservatism defends the right of Parliamentarians to criticise judges

"The outrageous comments made by Lady Chief Justice Carr, rebuking Sir Keir Starmer and Kemi Badenoch for criticising a judge’s ruling, highlight one aspect where our democratic system is broken. Unlike the United States, we do not have a separation of powers.

Parliament is the arbiter of the law in the UK and parliamentarians have every right to speak out when they feel the judiciary has got it wrong.

It is the way our unwritten constitution has worked for centuries. But after Tony Blair removed the historic Law Lords and implemented a Supreme Court, our elected representatives have become increasingly powerless and our country less democratic. In some policy areas, Parliament has become impotent as activist judges can effectively make up the law as they go along and extend their remit.

“This is a stunning example of judicial overreach. It’s outrageous that not only does Lady Chief Justice Carr believe that the pronouncements of the judiciary should outrump decisions made in Parliament, she also thinks that MPs should be barred from stating any opinions on judicial decisions. This is a totally unacceptable position for a senior judge to take. She should be removed. The Supreme Court should be abolished and its powers returned to the Law Lords.”
