"Migrants should be banned from using human rights laws to fight deportation in the British courts, Kemi Badenoch has said. In her most significant policy announcement to date, the Tory leader said she would disapply the Human Rights Act for all immigration cases. Her intervention comes after The Telegraph reported a series of highly controversial rulings at asylum tribunals.... moves the Tories closer to advocating for a full withdrawal from the European Convention on Human Rights (ECHR).
...Mrs Badenoch said the move was needed to end “extremely distorted interpretations of international laws” that were hampering border controls. “It’s critical to shift immigration powers from the courts to Parliament and elected ministers, enabling more effective control over our borders,” she said... The Tories will challenge Labour to back the plan this week by tabling it as an amendment to the Government’s Border Security Bill. Under the proposal, the Human Rights Act, which gives the ECHR direct effect in UK courts, would be disapplied for all aspects of immigration control..."
POPCON SAYS: A PopCon survey from last summer (August 2024) showed that 86% of Conservative members want the Conservative Party to commit to leaving the ECHR (and repealing the Human Rights Act).
